Acceptance of Terms

By accessing, browsing, or using any part of our website at mictest.online (the "Site") or any of the tools, features, or services provided therein (collectively, the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms").

If you do not agree to all of these Terms, you must immediately discontinue use of the Site and all associated Services. These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Mic Test ("we," "us," or "our").

Description of Service

Mic Test provides a free, browser-based microphone testing suite. Our Service enables users to test, diagnose, and analyse their audio input devices entirely within their web browser using the Web Audio API and related browser technologies. The Service includes, but is not limited to, the following tools and features:

Real-Time Waveform & Frequency Analyser — live oscilloscope and FFT spectrum display at up to 60 FPS
Live Monitor & Echo Test — real-time microphone monitoring through headphones or speakers
Record & Playback — in-browser audio capture, instant playback, and WebM download
Mic Comparison (A/B Test) — side-by-side recording and playback comparison of two microphones
Noise Environment Test — SNR analysis and noise floor measurement under real-world conditions
Device Diagnostics — full readout of device name, sample rate, channel count, latency, and driver info
Gain Control & Audio Filters — software gain boost, noise suppression, echo cancellation, and AGC toggles
Guides & Knowledge Base — step-by-step articles covering microphone setup, troubleshooting, and optimisation

The Service is provided free of charge with no account or registration required. We reserve the right to modify, expand, or discontinue any part of the Service at any time without prior notice.

Eligibility

The Service is intended for use by individuals aged 13 years or older. By using the Service, you represent and warrant that you meet the following eligibility requirements:

You are at least 13 years of age. If you are between 13 and 18 years old, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
You have the legal capacity to enter into a binding agreement in your jurisdiction of residence.
You are not barred from receiving the Service under the laws of the United States or any other applicable jurisdiction.
If accessing the Service on behalf of a business or organisation, you represent that you have the authority to bind that entity to these Terms.

We do not knowingly collect personal information from children under the age of 13. If we become aware that a child under 13 has provided us with personal information, we will take steps to delete such information in accordance with applicable law.

All rights not expressly granted herein are reserved by Mic Test. Nothing in these Terms grants you any right to reproduce, distribute, create derivative works of, publicly display, or commercially exploit any portion of the Service without our express written consent.

Prohibited Use

You agree not to engage in any of the following prohibited activities when using the Service. Violation of these restrictions may result in immediate termination of your access to the Service and may expose you to legal liability:

Reverse engineering or decompiling any portion of the Site's source code, algorithms, or functionality
Scraping, crawling, or data-mining the Site using automated tools, bots, or scripts beyond what is permitted for standard search engine indexing
Framing or mirroring any content from the Site without our prior written consent
Transmitting malware, viruses, or any harmful code that could damage or interfere with the Site, servers, or third-party systems
Impersonating Mic Test or any of its employees, affiliates, or representatives in any communication or platform
Recording other people's voices or audio without their explicit informed consent using our Service
Using the Service in any unlawful manner or in violation of any applicable local, state, national, or international law or regulation
Attempting to gain unauthorised access to any part of the Site, its servers, or any database, system, or network connected to the Site

Zero Tolerance Policy
We reserve the right to block, restrict, or permanently ban any user or IP address that we reasonably believe is engaged in prohibited activity. We may report suspected illegal activity to appropriate law enforcement authorities.

Microphone & Audio Data

We take your audio privacy extremely seriously. The following terms govern how microphone access and audio data are handled by the Service:

Zero-Knowledge Architecture — Verified Promise
All audio processing occurs entirely within your browser. No audio data, voice recordings, microphone signals, or audio metadata are ever transmitted to our servers, stored in any database, or shared with any third party — at any time, under any circumstances.
Local processing only: The microphone stream is captured by your browser's Web Audio API and processed within a JavaScript sandbox that exists solely in your browser tab's memory.
Session-only retention: Any audio processed during your session is destroyed immediately when you click Stop, navigate away, or close the browser tab. Nothing persists.
User-controlled permission: Microphone access requires your explicit consent via the browser permission prompt. You may revoke this permission at any time via your browser settings.
No voice profiling: We do not perform speaker identification, voice fingerprinting, sentiment analysis, or any other form of voice-based profiling.
Your responsibility: You are solely responsible for obtaining any necessary consents from third parties before testing or recording audio that includes their voices using our Service.

Intellectual Property

The Service and all of its original content, features, functionality, design elements, visual assets, written guides, code, and trademarks are the exclusive property of Mic Test — Team Management Office and are protected by applicable intellectual property laws, including copyright, trademark, and trade secret laws of the United States and international treaties.

You may not reproduce, duplicate, copy, sell, resell, visit, or otherwise exploit any portion of the Service or its content for any commercial purpose without express written permission from us. Specifically, the following are protected:

The "Mic Test" name, logo, and brand identity
All written guides, articles, FAQ content, and knowledge base materials
The design, layout, user interface, and visual presentation of the Site
All JavaScript code, algorithms, and tool implementations

Third-party tools, libraries, and technologies used in the Service (such as the Web Audio API and browser-native technologies) are the property of their respective owners and are used in accordance with their applicable licences.

Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MIC TEST EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

Implied warranties of merchantability — we do not warrant that the Service is fit for any particular purpose
Warranties of uninterrupted or error-free operation — the Service may experience downtime, bugs, or technical issues
Accuracy of diagnostic results — test results are informational only and depend on your hardware, browser, and OS configuration
Compatibility with all devices and browsers — feature availability depends on browser Web Audio API support

Mic Test does not warrant that the results obtained from the use of the Service will be accurate, reliable, complete, or meet your specific requirements. The Service is intended for informational and diagnostic purposes only and should not be the sole basis for any professional audio engineering, legal, or technical decision.

Browser Compatibility Note
The Service relies on the Web Audio API, which is supported in all modern browsers. Internet Explorer is not supported. Some features may behave differently across browsers and operating system versions. We recommend Chrome or Edge for the most accurate results.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MIC TEST, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

Loss of profits, revenue, data, goodwill, or business opportunities
Damages resulting from reliance on inaccurate or incomplete test results
Costs of procuring substitute services or products
Any interruption, suspension, or termination of the Service
Unauthorised access to or alteration of your transmissions or data

IN NO EVENT SHALL MIC TEST'S TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED ONE HUNDRED US DOLLARS (USD $100.00), REGARDLESS OF THE THEORY OF LIABILITY OR THE FORM OF ACTION.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages. In such jurisdictions, the above limitations may not apply to you, but shall apply to the fullest extent permitted by law.

Modifications to the Service

Mic Test reserves the right, at our sole discretion and without prior notice, to:

Modify, update, enhance, or discontinue any feature, tool, or component of the Service at any time
Introduce new features, tools, or services — which may be subject to additional terms
Temporarily or permanently suspend the Service for maintenance, upgrades, or security purposes
Limit access to all or part of the Service in certain geographic regions or to certain users

We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service. We will endeavour to provide notice of significant changes where reasonably practicable.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States of America, without regard to its conflict of law principles. You agree that any legal action or proceeding arising out of or related to these Terms or your use of the Service shall be brought exclusively in the federal or state courts located in Kern County, California.

You hereby consent to and waive any objections to personal jurisdiction and venue in such courts. If you are accessing the Service from outside the United States, you are responsible for compliance with all local laws applicable to your jurisdiction.

Dispute Resolution

Before initiating formal legal proceedings, we encourage users to contact us directly at info@mictestpro.com to resolve any dispute informally. We will make reasonable efforts to address and resolve complaints within 30 business days of receiving written notice.

If informal resolution is not possible, and to the maximum extent permitted by law, you agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding arbitration rather than in court, except where:

Either party seeks emergency injunctive or other equitable relief to prevent irreparable harm
The claim falls within the jurisdiction of a small claims court
Applicable law prohibits mandatory arbitration of the particular claim

Class Action Waiver: To the fullest extent permitted by law, you agree that any dispute resolution proceedings will be conducted on an individual basis only, and not as part of a class, consolidated, or representative action.
